Terms and conditions of service

Courses organized by BeBe Bold

The purpose of these General Terms and Conditions of Service (hereinafter referred to as "GTS") is to inform any customer (hereinafter referred to as "the participant") registering for a workshop or course about the terms and conditions under which BeBe Bold (hereinafter referred to as "the organizer") sells and delivers a service, and to define the rights and obligations of each party. Only the special conditions that may be specified in the course description and these T&Cs shall govern the conditions of sale of the services offered by the organizer. They shall prevail over any clauses and conditions that may appear on the participant's orders or other documents.

1. Application

Any course or workshop hosted by BeBe Bold, whose SIRET number is 843 457 722 00026, is subject to the present T&Cs. Signing the registration form or purchasing the course via the https://bebebold.eu website implies the participant's full and unreserved acceptance of the T&Cs. No special condition may prevail over the present GCS, except in the case of a formal written derogation signed by the participant and the organizer, and appearing on the registration form which has become firm and definitive. The organizer reserves the right to modify the content of these GTS at any time and without notice. The applicable terms and conditions are those in force on the date the service is booked, and are also sent to the participant by e-mail with the registration form before payment is made, which constitutes final and unconditional acceptance of the above conditions.

2. Registration

2.1. - By registering for a workshop or course, the participant confirms that he/she has read and understood these GTCS.

2.2. - Registration for a course or workshop is only deemed to be confirmed once the total amount has been paid in accordance with the payment terms explained in point 3. of these GTCS.

2.3. - Registration for a workshop or course is subject to the participant's availability on the date specified at the time of registration.

2.4. - In the event of registration of a participant by a third party (e.g. a gift voucher), responsibility for the participant's participation lies with the third party who made the reservation. Likewise, the third party making the booking undertakes to ensure that the participant registered by him or her is aware of and complies with these GTS.

2.5. - Reservations are always confirmed by return e-mail from the organizer to the person who has registered. However, in the event of non-receipt of the full amount due within 7 calendar days of the reservation date, the organizer will cancel the reservation and the reserved place will be made available to other participants.

3. Payment conditions

Before any service is rendered, an invoice is drawn up and sent to the participant. The content of the invoice is modified according to the needs of the participant; it is accompanied by these general terms and conditions and contains the following information :

- the title of the service to be provided ;

- the date(s) of the service;

- the total amount agreed for the service.

- all payment details (account number to be credited, payment date, etc.);

Payment for the entire service must be made as soon as the reservation is made, and within a maximum of 7 calendar days from the date of reservation. Payment can be made by bank transfer, cash or cheque.

4. Workshop and course prices

The price of the courses and workshops offered by the organizer is expressed in euros (€).

- The amount includes :

- coaching and facilitation of workshops and courses ;

- detailed advice and feedback on completed projects.

- Supplies detailed in the list

- The amount does not include :

- equipment ;

- accommodation ;

- travel to and from the course or workshop location;

- travel by car or other means during the course or workshop;

- various insurances.

Revision: prices may be revised at any time. Only the price indicated on the registration form and accepted by the participant is definitive.

5. Locations

The courses offered by the organizer take place indoors, at Carré Claude Nicolas or on another site.

6. Cancellation

Cancellations can be of two kinds: on the initiative of the participant, or on that of the organizer. The following should therefore be taken into consideration:

6.1. - Cancellation by the participant:

- Cancellations received 15 days or more before the workshop date will be fully refunded.

- Cancellations received less than 15 days before the course will unfortunately not be refunded, unless the participant is able, at the time of cancellation, to propose another person to replace him/her without economic loss to the organizer.

6.2. - Cancellation by the organizer :

- In the event of low participation (less than two people registered), the organizer reserves the right to cancel the course. In this case, all sums paid by participants will be reimbursed.

- Expenses incurred by participants to attend the course (accommodation, transport, etc.) will not be reimbursed by the organizer.

7. Calendar

7.1. - General : all participants, when registering for a course and/or workshop (including those registered by a third party, see paragraph 2.5), are responsible for respecting the start and end times of the course and/or workshop in which they are participating. Consequently, no reimbursement will be made for hours or days missed due to late arrival or early departure.

7.2. - Late arrival: if a participant arrives late, the organizer will start the course or workshop at the scheduled time so as not to penalize the other participants

7.3. - Early departure: in the event of early termination of the course by one of the participants, the latter will be responsible for the resulting costs (transport, accommodation, etc.). Any participant leaving a workshop before the end of the course will not be entitled to any refund, total or partial, of the sums paid.

7.4. - Sickness/Accident: If early departure is due to sickness or accident during the course, the participant must take out his or her own sickness/accident insurance (or repatriation insurance, if necessary), which we recommend participants take out before departure.

8. Liability and insurance

These concepts apply, depending on their nature, to the organizer or the participant. The various cases are explained below:

8.1. - Participant liability :

- Participation in activities may involve certain risks. The participant acknowledges and accepts this fact. The participant also undertakes not to pass on responsibility for these risks (injuries of any kind, material damage, medical expenses, repatriation costs, transport costs to leave the course, economic losses, etc.) to the organizer or his assigns.

- The participant in a workshop or course therefore undertakes to be in possession of valid insurance covering these risks.

- By registering for a workshop or training course, the participant automatically acknowledges having read, understood and accepted the present terms and conditions, which have the value of a contract between the organizer and the participant. Consequently, the participant undertakes to have prepared (both physically and materially) for the workshop or course in accordance with the instructions given by the organizer at the time of booking confirmation, and to arrive at the meeting point with the necessary equipment indicated in the course description.

- Each participant is responsible for his or her own equipment and person, and the organizer cannot be held responsible for any theft, personal injury or material damage occurring during the course or workshop.

8.2. - Responsibility of the organizer :

- The organizer undertakes to do everything in his power to ensure the smooth running of the courses as described on his website.

- On the other hand, the organizer will not assume responsibility for services which he cannot control (hotels, gîtes, transport companies, etc.).

- Under no circumstances can the organizer be held responsible for additional costs, losses, material or physical damage, bodily injury, delays and/or economic losses caused by third parties, if this is not due to direct negligence on the part of the organizer.

- In addition to article 4 concerning services not included, the organizer cannot be held responsible for unforeseeable incidents or events beyond his control during the course or training period, resulting in delays, additional costs and/or changes to the itinerary.

- The organizer declines all responsibility for any loss, damage or theft of equipment, clothing or personal items during the course or workshop, which remain under the participant's supervision and responsibility for the duration of the course or workshop.

9. Force Majeure

The organizer cannot be held responsible for any damage or loss suffered by the participant as a result of any fortuitous event or force majeure, such as any act emanating from a civil or military authority, strike, fire, flood, water damage, storm or lightning, accident, riot, attack, any act attributable to a third party, or any other circumstance having an external cause and preventing him, directly or through a third party, from fulfilling his commitments.

10. Privacy

All information provided by the participant during the booking, payment and workshop process remains confidential, and the organizer undertakes to comply with current legislation on the protection of personal data and privacy. Consequently, the organizer undertakes not to pass on this information to third parties in any form or under any conditions whatsoever. Participants are reminded that they have the right to access and rectify their personal data in accordance with the French Data Protection Act of January 6, 1978.

11. Tolerance

The fact that one of the parties has not demanded the application of all or part of the commitments provided for in these GCS, either permanently or temporarily, shall not constitute a modification of the said conditions or give rise to any right whatsoever.

12. Nullity

In the event that any provision of these General Terms and Conditions of Sale should be null and void in application of a current rule of law or a final court decision, such provision shall be deemed unwritten, without invalidating the present contract or altering the validity of its other provisions.

13. Complaints

Any complaint by a participant must be made within four working days of the end of the course or course services. The organizer's liability is limited to the value of the service provided to the participant.

14. Jurisdiction

Any dispute relating to the interpretation and execution of these GTS general terms and conditions is subject to French law. Failing amicable resolution, in the event of dispute over the terms of the present contract, or in the event of non-performance, the parties submit to the jurisdiction of the Courts of Besançon for the interpretation and performance of the contract and its consequences.
